1. GENERAL PROVISIONS.
1. Niniejszy regulamin określa zasady korzystania ze sklepu internetowego MindOut pod adresem internetowym www.mindout.pl, należącego do Tymoteusz Gzyl Design, ul. Grunwaldzka 76/78 lokal 122, 80-244 Gdańsk, działającego na podstawie wpisu do Centralnej Informacji i Ewidencji Działalności Gospodarczej, numer NIP 9571147008, REGON 522803746, numer telefonu 511604510.
2. DEFINITIONS. Terms used herein shall mean:
a. Shop – internet service running on www.mindout.pl belonging to Tymoteusz Gzyl Design, ul. Grunwaldzka 76/78 lokal 122, 80-244 Gdańsk, acting on the basis of entry into the Central Information and Register of Business Entities, tax identification number 9571147008, statistical number 522803746. www.mindout.pl należący do Tymoteusz Gzyl Design, ul. Grunwaldzka 76/78 lokal 122, 80-244 Gdańsk, działającego na podstawie wpisu do Centralnej Informacji i Ewidencji Działalności Gospodarczej, numer NIP 9571147008, REGON 522803746.
b. Sale - steps taken in order to conclude the purchase contract between the Client and the Shop. The sale takes place exclusively via the Shop, on the terms set out herein.
c. The Client - natural person which undertakes activities aimed at the purchase of Goods via the Shop.
d. Price - means the price to be paid by the Client. Indicated prices include VAT.
3. Using the Shop constitutes acceptance of these Terms and Conditions and a commitment to respect the principles contained therein.
4. All rights to the content in the Shop belong to Tymoteusz Gzyl Design. None of the elements of the Shop (graphics, logos, texts, domain, etc.) can not be reproduced and distributed in whole or in part in any form or by any means (including electronic or mechanical on any of the fields of exploitation), including copying, photocopying including Internet - without the prior consent of the owner of the Shop.
5. It is forbidden to use of the Shop in a way that distorts its normal functioning. Where there is any abuse, Shop has the right to prevent the Client from further use.
2. SALE.
1. Shop presents on its website digital photographs of the offered Goods, along with their descriptions, dimensions and Price. Such proposal shall be considered as an invitation to tender within the meaning of art. 661 § 3 of the Polish Civil Code
2. The photographs are for depicting the overall image of the Goods and its basic features only. Goods may vary slightly from the photograph taken, particularly in terms of colors depending on the monitor settings. Such differences can not be the basis for any claims of the Client.
3. Before transaction the Client confirms, that read and accepted the rules in the current form. If in doubt, it is recognized that the performance of the first activities related to the purchase constitutes acceptance of these rules and consent to its use at the conclusion of the transaction by the Client.
4. The buyer places an order by placing the Goods in the shopcart and acceptance of the Price and cost of shipment.
5. Placing an order constitutes Client’s consent to the processing of it’s personal data by the Shop in accordance with the Act of August 29, 1997. On the protection of personal data (ie Dz. U. of 2002, No. 101, item. 926, as amended. D.) in order to successfully implement the transaction.
6. When placing the order in Shop, the Client shall provide the data: e-mail address, name, surname, address and telephone number.
7. The Client is obliged to provide truthful information. For any effects of giving outdated or inaccurate data full responsibility to the Shop and third parties shall be borne by the Client.
8. Payment of the Price and shipping costs means the conclusion of the Sales Agreement. The store does not offer cash on delivery.
In our store, payments are handled by PayNow, operating under the company mBank S.A with its registered office in Warsaw, ul. Prosta 18, postal code: 00-850, KRS: 0000025237.
The entity providing online payment services in the field of card payments is Blue Media S.A.

If there is a need to return funds for a transaction made by the customer with a payment card, the seller will refund the funds to the bank account assigned to the payment card of the Client.
9. In case the Price is not paid within 3 days from the date of placing order, the purchase contract is not concluded and the order is cancelled.
10. Delivery of the Goods is carried out on Polish territory and abroad by the delivery service.
3. RIGHTS AND OBLIGATIONS OF THE BUYER.
1. The Client must be of legal age and having full legal capacity and have an e-mail account.
2. When placing the order, Client is responsible for giving the correct data necessary for the execution of the Purchase Contract.
3. Shipping costs in the amount depending on the chosen form of shipping shall be borne by the Client.
4. RIGHTS AND OBLIGATIONS OF THE SHOP.
1. Shop has the right to refuse the realization of the order placed by a Client who does not comply with the provisions of these Regulations.
2. Shop is not responsible for interruptions in its functioning due to any cause beyond its control.
5. WITHDRAWAL FROM THE CONTRACT.
1. The Client may withdraw from the contract without giving any reason within 14 days from the date of receipt of package (according to the Act of March 2, 2000. On the protection of consumer rights and liability for damage caused by dangerous products, Dz. U. No. 22, pos. 271, as amended. d.), under the following conditions:
a. returned Goods can not bear traces of use,
b. returned Goods can not be damaged.
2. Przesyłki ze zwrotem należy przesyłać na adres: Tymoteusz Gzyl Design, ul. Grunwaldzka 76/78 lokal 122, 80-244 Gdańsk.. Wszelkie koszty oraz ryzyko związane z odesłaniem Towaru ponosi Klient. Przesyłki na koszt odbiorcy bądź inny adres nie będą odbierane.
3. Promotional Sales:
In the case of promotional orders to which additional promotional products are added, the condition for effective withdrawal from the contract is the return of the ordered product together with the accompanying promotional product.
Multi-product transactions with a progressive discount:
- The store may grant a progressive discount depending on the value of the transaction when purchasing multiple products.
- When returning one of the products purchased as part of such a transaction, its value reduces the value of the entire transaction and thus reduces the value of the progressive discount granted.

3*. Wyjątkiem są spersonalizowane, produkty podlegającym specjalnym promocjom czasowym – np. Mystery Box. Te produkty nie podlegają zwrotom i wymianą.
4.In the event of an effective withdrawal, the Store returns the paid Price to the Buyer through the payment channel used by the Buyer within 14 days of receiving the return shipment.
5. Podstawa i zakres odpowiedzialności Sprzedawcy względem Klienta, jeżeli sprzedany Produkt ma wadę fizyczną lub prawną (rękojmia) są określone w przepisach ustawy Kodeks Cywilny, w szczególności w art. 556 i następnych Kodeksu Cywilnego.
6. COMPLAINTS.
1. The complaint arising from the non-delivery by delivery service:
a. The complaint arising from the failure to deliver the consignment to the Client can be made only after the expiry of the maximum time for its delivery. This period is specified in the rules of the delivery service company. Shipment is considered to be lost in the absence of notification within 30 days from delivery date. The Client shall notify the Shop in regard of the failure of delivery via the contact form or e-mail.
b. Shop shall enter the complaint in the delivery service company providing the transport service.
c. Shop shall inform the Client in regard of any action taken related to complaint.
d. Shop after receiving compensation from the delivery service company, shall return to the Client the full price by a transfer to indicated by Client bank account.
2. The complaint resulting from damage during the transport by delivery service company.
a. The Client is obliged to open the package in the presence of the courier to determine whether it is not damaged. Checking must take place especially in the case of visible damage to the packaging.
b. In case of damage Client is obliged to draw up a protocol of damage while receiving the consignment in the presence of a representative of the delivery service company. The protocol should describe in detail the type, degree, nature and location of damage. The protocol should include the sender's data as well as the waybill number. The protocol must be signed by the courier in the way allowing his identification and dated. It is advisable to take pictures showing the damage to the consignment and / or packaging.
c. The delivery service company will consider of the complaint for damage to or loss of contents of the shipment under the condition that both the contents of the shipment and the original packaging is available to check. Therefore, the Client should keep the shipment including packaging for inspection.
d. The Client is obliged to immediately notify the damage and deliver to the Shop the protocol of damages.
e. When receipt of the protocol the Shop shall immediately make a complaint to the delivery service company.
f. Each shipment send by the Shop is insured. When the complaint is accepted, the Shop shall refund to the Client the compensation received from the delivery service company by a transfer to indicated by Client’s bank account.
3. The complaint arising from the delivery of defective Goods
a. When defective Goods received, the Client has the right to demand its repair. In this case, Client should immediately contact the Shop and provide the following information: name and surname, transaction number and detailed description of the defect. It may be advisable to take some photos showing the defects of Goods.
b. Complaints concerning the difference in the appearance of Goods ordered and the Goods received which result from the difference in setting the monitor’s parameters of the Client, in particular the difference in colors and shades of the materials from which the Goods has been done, do not constitute any base for the complaint.
c. The Goods which subject to complaint the Client shall send to the Shop at his own expense.
d. Any complaints are dealt with by the Shop within 7 days of receipt of the Goods.
e. The defective Goods will be repaired or replaced by the other by the Shop, if it is possible. If repair or replacement is not possible, Shop will reimburse to the Client both Price and cost of shipment paid when purchased.
If there is a need to return funds for a transaction made by the customer with a payment card, the seller will refund the funds to the bank account assigned to the payment card of the Client.
7. PERSONAL DATA PROTECTION.
1. The administrator of personal data provided by its Clients is Tymoteusz Gzyl Design. These data are processed in accordance with art. 23 section 1, paragraph 1, section 3, paragraph 5 of 29 August 1997. Protection of Personal Data (t. J. Journal of Laws of 2002, No. 101, item. 926, as amended. D.).
2. The Client places an order consents to the collection and processing of personal data for the purposes realization of an agreement.
3. The Client has the right to inspect its personal data and update them. The Client can request the deletion of its personal data from the database.
8. CHANGES IN THE RULES.
1. Shop reserves the right to change these Terms and Conditions at any time.
2. The new content of the Regulations enters into force at the time of placing it on the websites of the Shop.
9. DISPUTES.
Any disputes related to the services provided by the Shop under these Regulations shall be settled by Polish common courts.
Account registration
1. The Regulations define the conditions for the provision of electronic services by Tymoteusz Gzyl Design.
2. Before registering an account, the User should read the Regulations and the Privacy Policy.
The User confirms that he has read the Regulations and accepts the provisions contained therein in full and without reservations.
3. Account registration is tantamount to acceptance of the Regulations and the Privacy Policy.
4. Pursuant to Art. 8 sec. 3 of the Act on the provision of electronic services, the Regulations specify in particular:
– types and scope of services provided electronically,
– conditions for the provision of electronic services,
– conditions for concluding and terminating contracts for the provision of electronic services,
– complaint procedure.
10% discount code when registering an account
1. The subject of the Promotion is a discount code enabling a 10% discount on products not discounted from mindout.pl
2. The discount is granted once to a registered account.
3. The discount cannot be combined with promotions, discounts, reductions, rebates. The code is one-time, awarded to the first order placed from a registered account.
4. If the Customer returns a Product purchased as part of the Promotion, the Store will return to the Customer only the price actually paid for the Product (reduced by the value of the Discount).
